When you visit www.idRIDER.com (“Website”), or our mobile application and use our services, you trust us with your personal information. We take your privacy very seriously. In this privacy policy we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We urge you to take some time to read through it carefully, as it is important. If there are any terms in this privacy policy that you do not agree with, please discontinue the use of our website, mobile application and our services.

This privacy policy applies to all information collected through our Website, idRIDER mobile application, and/or any related services, sales, products, or marketing (“Services”). It does not apply to any third-party, like our affiliates, including through any application or content that may link or be accessible via our Services. Those third parties may handle your personal information differently than we do, so we also urge you to become aware of how they handle your personal information.   1. Personal information we collect

We collect personal information from you when you use our Services as well as any time you communicate with us. The personal information that you provide to us (or which is provided to us via our rewards program) and which we retain may include your name, contact information (including e-mail address, mailing address, phone number, and date of birth), photo IDs, profile pictures, passwords, and security data. We may also collect third-party log-in credentials, like Apple ID for our mobile application. Payment information like credit card numbers, security codes, and expiration dates are also collected by us and by our payment processing vendor. In the case of merchants, we collect data including merchant owner contact information, shop or website address, and photos of physical shop locations. If you contact us, we collect any records of correspondence between you and us. Further, we collect details of transactions facilitated via our Services and search queries on our Website or mobile application.

Information automatically collected

Some information is collected automatically when you visit or use our Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser type and characteristics, operating system, referring URLs, and information about how and when you use our Services and other technical information. We also use tools such as cookies and location data to gather information regarding user preferences, time and date of usage, and access to our Services.

Information collected through our mobile application

We may collect information regarding your mobile device, and through push notifications when you use our app. Information we may collect about you and your mobile device through the mobile application includes device model, stored information, and files (like photos or contacts), and usage details about when and how you use the mobile application. The App also allows for photos to be taken within the App itself to be used with the Services. Additionally, use of the mobile application collects real-time location data. And any action taken within the mobile application is recorded and tracked to ensure the most accurate location of a user’s ride. If you wish to change our access or permissions, you may do so in your device's settings.

Our mobile application also facilitates a Roadside Assistance program. This program, available to subscribing users, allows you to send information like your location, a description of a mechanical problem, and a photo of the bike (or other personal transportation device) out to other users in order to find help. The information you send out in your assistance request is via a push notification to which other users may respond directly back to you. Thus, the information shared with others in your assistance request and in their response will be collected by our mobile application.

  1. How we use your information

We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, and compliance with our legal obligations.

Examples of how we use your information include:

  • To present our Website or mobile application and their contents to you.
  • To provide you with products, services, or information that you request from us.
  • To notify you about any changes to our Services.
  • To facilitate account creation and logon process.
  • To verify information you have provided about yourself and your account.
  • To respond to your questions or concerns, or otherwise communicate with you.
  • To provide you with other services and offers, such as the opportunity to donate to the Theft Recovery Donation Fund.
  • To send you information about potential security concerns or threats.
  • For any other purpose with your consent.

In addition to the above examples, we use your information to send you marketing and promotional communications. We and/or our third-party marketing partners may use the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt-out of our marketing emails at any time.
We use your information to enforce our Terms of Service, to respond to legal requests and, prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.

We may use personal information and other information about you to create de-identified and/or aggregated information, such as de-identified demographic information, de-identified location information, information about the device from which you access our Services, or other analyses we create.

If you provide feedback about our Services, we may use your feedback for any purpose provided we will not associate that feedback with any information which could be personally identifiable.

 

  1. How we disclose your information

We may disclose aggregated, deidentified information about our users without restriction.

Further, we may disclose personal information that we collect or which you provide as described below:

  • We may share your personal information with our affiliates to provide technical support or other services, for instance, hosting your applications, maintenance services, database management, or payment processing. Our affiliates will only have access to your information to perform these services on your behalf, and are obligated not to disclose your information any further.
  • We may share your personal information with third parties to enable features of the services, for example, providing multi-factor authentication for registration and log-in.
  • We may provide your personal information to police departments for the purpose of establishing a line of communication with you.
  • We may share your personal information with our subsidiaries, ventures, or other related entities. If your personal information is shared with any of these entities, they will be bound by this privacy policy.
  • If our business or its assets is acquired, restructured, reorganized, dissolved, or otherwise involved in a merger, we will share your personal information with the acquirer, and they will then assume responsibility for it under this privacy policy.
  • If you do not purchase the idTAG, but you continue to use our Services beyond the 60-day free trial, we may sell and/or share your personal information to third parties.
  • We may share your personal information for the purposes for which you provide it. For example, if you would like to refer a friend via e-mail, we will send the contents of your message and your e-mail address to the chosen recipient.
  • We may share your personal information for any other purpose disclosed by us when you provide the information.
  • We may share your personal information for any other reason with your consent.

We may also disclose your personal information in other circumstances, like those described below:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Service and other agreements, including for billing and collection purposes.
  • If we believe that disclosure is necessary to protect the rights, property or safety of our business, users, or others. For example, disclosing personal information to other companies or organizations to prevent fraud.

 

  1. Use of cookies

Our Services use cookies. A cookie is a small file placed on the hard drive of your computer. You may refuse to accept cookies by activating the appropriate setting on your browser or mobile device. However, if you select this setting you may be unable to access certain parts of our Services. Unless you have adjusted your browser or device setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website or open our mobile application in order to present you with the best experience possible.

We directly set two types of cookies. One type are cookies related to account sign-up for the purposes of recording your personal information in case the sign-up process is not completed in a single effort. The other type of cookie we set is related to the log-in process. We set this cookie so that you do not have to sign-in every time you move to a new page in the Website or mobile application or open multiple browsing windows.               We also allow third-party cookies in some limited circumstances. For example, we use Google Analytics to review our business trends and data. Additionally, we allow some third-party cookies from social media services. These cookies can facilitate the connection of an idRIDER account with your social media accounts. Social media platforms that we facilitate connection with include Facebook, Instagram, and LinkedIn.

  1. Third-party websites

The Services may contain advertisements or other services from third parties which may link to other websites, online services or mobile applications. We cannot guarantee the safety and privacy of data you provide to any third parties. Any data collected by third parties is not covered by this privacy policy. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly to respond to your questions.

  1. Retention of personal information

Once you create an account and register a bike (or other personal transportation device), our Services will permanently associate your personal information with that bike (or other personal transportation device). When that bike (or other personal transportation device) is sold or transferred to someone different than the original owner, this creates a chain of ownership that is easy to track and creates a simple mechanism for identifying ownership.

If you register a bike (or other personal transportation device) and its serial number matches another registered bike in our system without indicating a legal transfer, we will treat that registered record as a duplicate and merge the new record into the original.

 

  1. Children’s information

We do not knowingly solicit or collect data from or market to children under 13 years of age. If we learn that personal information from users under 13 years old has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our system. If you become aware of any data we have collected from children under 13 years old, please contact us at admin@idrider.com.

  1. Your privacy choices and rights

You may review or change your account at any time and can stop using our Services at any time. If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. If you would at any time like to review or change the information in your account, you can log into your account settings and update your user account.

You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list – however, we will still need to send you service-related emails that are necessary for the administration and use of your account. To otherwise opt-out, you may access your account settings and update preferences. You may note your preferences when you register an account with the site.

 

  1. Your California privacy rights

Citizens of California may have additional, specific privacy related rights under state law. To comply with these laws, we:

  • Allow you to visit our website and application anonymously.
  • Notify you of any changes to our privacy policy by indicating a change of Effective Date at the top of the privacy policy page.
  • Clearly label our privacy policy as such on our homepage and provide a direct link to the policy.
  • Allow you to transfer account data to a new account in the case of forgotten log-in credentials (i.e. user name and password). To learn more about how to transfer account information in the case of lost or forgotten log-in credentials, please contact admin@idrider.com.
  • Give you the opportunity to request to change the personal information associated with your account with our Services.

  1. Data security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. For example, we facilitate multi-factor authentication for registration and log-in. But the safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.                Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to us. Any transmission of personal information is at your own risk.

 

  1. Changes to our privacy policy

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Effective” date at the top of the policy. The updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes on our website and application, or by directly sending you a notification.

 

  1. Account Deletion

Users have the right to request the deletion of their personal data from idRIDER. To delete an account, users must fill out a form accessible within their profile and verify their phone number and email address. Please note that while personal data can be deleted from idRIDER's systems, ride records and photos of the bike cannot be deleted from the blockchain system. After an account deletion, personal information may be accessible to law enforcement as required by law, but will not be sold to any third parties.  All personal information is encrypted to ensure the highest level of security and privacy.
